Terms and Conditions for PTV Tree Care Ltd​

Please read these Terms and Conditions carefully. By accepting a quote from PTV TreeCare Ltd, you agree to be bound by the following terms, which form a binding agreement between you, the "Client," and PTV TreeCare Ltd, its agents, owners, employees, and subcontractors, collectively referred to as the "Company."

1. Quotation Validity

All quotes provided by PTV TreeCare Ltd are valid for 7 days from the date of issue.

2. Deposit and Booking

Upon approval of a quote, a 50% non-refundable deposit is required to secure your booking.

​

Rescheduling and Cancellations:

  • Cancellation (3+ business days' notice): If you cancel at least 3 business days before your scheduled service, a 25% rescheduling fee will be applied to your deposit. The remaining 25% of the deposit will be refunded.

  • Date Change (3+ business days' notice): We will do our best to accommodate date change requests made at least 3 business days before your scheduled service, subject to availability and free of charge.

  • Cancellations within 3 business days: We are unable to offer refunds for cancellations made within 3 business days of the scheduled service. However, any remaining balance of your deposit (after the 25% rescheduling fee) can be applied toward a future service.

3. Permissions and Access

The Client or their representative agrees to grant the Company access to the property for the purpose of performing tree care and/or landscaping services. You understand that project timelines may vary due to unforeseen circumstances (e.g., weather, vehicle/machine maintenance, staff illness), and multiple visits may be required.

The Company also has permission to visit the property, with prior notice to the Client, to assess service needs before the scheduled date and to inspect completion after services have been rendered. The Client agrees to provide the Company with clear and unobstructed access to all work areas.

4. Acknowledgement of Risks and Release of Liability

Tree care and landscaping services involve the use of tools and machinery that carry inherent risks of damage or injury. PTV TreeCare Ltd technicians are highly trained and take extensive precautions to prevent harm to your property. However, damage can still occur due to:

  • Unforeseen circumstances

  • The inherent nature of the work

  • Pre-existing conditions of trees, plants, or property

  • Low-grade building materials

Homeowners should consult with relevant professionals regarding the structural integrity of their property and surrounding areas in relation to the contracted work. It is the Client's responsibility to ensure their property has been appropriately maintained and any defects or areas of concern are addressed before services begin. The Homeowner assumes all these risks and accepts responsibility for any damage that occurs due to the aforementioned explanations.

During the quotation process, the Company will visually inspect the property and provide a written examination of observable pre-existing damage, where applicable. This document is not exhaustive, as new damage may become apparent during service performance. If new damage is discovered, the Company will cease work in the affected area until the Client can view and acknowledge its existence.

The Client also agrees to release the Company from any and all liability for injuries sustained due to equipment placement, including injuries from tripping/falling, striking equipment, falling debris, or equipment.

5. Media Release

The Client agrees to allow the Company to use any photos, descriptions, reviews, quotes, or videos of the property and/or the Client in the context of marketing or advertising for PTV TreeCare Ltd. The Company will use these items without any compensation to the Client. The Client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the aforementioned media examples. This includes the use of photos, testimonials, and videos posted or displayed on online venues such as social media and/or the Company’s website. No information regarding the property's address will be shared online unless explicitly approved by the Client.

6. Correction of Damages

PTV TreeCare Ltd shall only be obligated under this Contract for structural damages to the property that are a direct result of operator error, gross negligence, or wilful misconduct. Damages must be discovered and reported within 3 calendar days of completion of the work.

If you believe damage was caused by our mistake, please formally report it to us via the email address provided on your invoice or our website. Upon receipt of written notice, the Company shall have 30 calendar days from the date of receipt to inspect the premises. PTV TreeCare Ltd shall have the sole option of repairing or contracting repair work to correct any structural damages directly resulting from the Company's actions.

7. Payment Terms

Payment is due at the completion of the discussed work, unless alternative arrangements have been made and initialled on the service agreement.

Collection of Outstanding Debt:

PTV TreeCare Ltd reserves the right to initiate small claims court proceedings to collect all outstanding debt. All legal fees incurred will be added to the remaining unpaid balance. This contract is binding.

  • At 30 days past due, a formal notice of intent to file a claim will be sent via registered mail.

  • An interest rate of 2% per month will begin accruing after day 31 of non-payment.

8. Specific Service Acknowledgements​

Rock Landscaping Acknowledgement:

The Client understands that rock landscaping involves the placement and arrangement of natural materials, and the final appearance may vary slightly from initial plans or expectations due to the unique nature of rocks. The Client acknowledges that the stability and longevity of rock features depend on proper installation and site conditions. The Company is not responsible for settling, shifting, or movement of rocks due to natural ground movement, erosion, or improper maintenance by the Client. The Client also understands that weed growth may occur between rocks and ongoing maintenance may be required.

Ready Lawn (Installation) Acknowledgement:

The Client understands that the successful establishment of ready lawn depends on proper ground preparation, watering, and maintenance following installation, as outlined in any provided care instructions. The Company is not responsible for turf failure, disease, or discolouration due to inadequate watering, pest infestation, fungal growth, or other factors beyond the Company's control after installation is complete and initial instructions have been provided. The Client acknowledges that seams between turf rolls may be visible initially and may require time to blend fully.

Masonry Landscaping Acknowledgement:​

The Client understands that masonry landscaping (e.g., retaining walls, patios, pathways) involves working with materials such as bricks, blocks, and stone, and slight variations in colour, texture, and appearance may occur. The Client acknowledges that the structural integrity and longevity of masonry work depend on proper installation and site conditions. The Company is not responsible for cracking, shifting, or other damage due to ground movement, water damage, or improper maintenance by the Client, unless directly caused by gross negligence or wilful misconduct during installation. The Client also understands that efflorescence (white powdery deposits) may naturally occur on masonry surfaces and is not a sign of faulty workmanship.

General Landscaping Acknowledgement (Applicable to other services like planting, mulching, etc.):

The Client understands that landscaping involves working with natural elements, and the growth and performance of plants and other materials are subject to environmental conditions, maintenance, and other factors beyond the Company's direct control after installation. The Company provides guidance based on best practices but cannot guarantee specific outcomes regarding plant survival, growth rates, or long-term appearance. The Client is responsible for ongoing care, including watering, fertilisation, and pest control, unless specifically included in a maintenance agreement.

9. Possibility of Cancellation by Company

Due to unforeseen circumstances (e.g., severe weather, vehicle or machinery maintenance, staff illness), your appointment may need to be moved to the next available business day. We will do our best to accommodate a quick reschedule, but we must work around other scheduled clients and weather conditions.

10. Agreement to Terms

By accepting a quotation from PTV TreeCare Ltd, the Client agrees that all the specifications and conditions outlined in this document are satisfactory and hereby accepted. You release PTV TreeCare Ltd from property damage unless such damage is caused by gross negligence or wilful misconduct. PTV TreeCare Ltd is not responsible for damage to items not properly moved from the work area, or for pre-existing conditions that become more apparent after the service. Any damages due to the above remain the responsibility of the owner.
